In a Collin County trial, in a business tort case, the Firm successfully defended all causes of action including conversion, trespassing, and under the Texas Theft Liability Act. The Firm also obtained an award of attorney’s fees at a higher market rate rather than the rate actually incurred by the client.

In a Harris County trial, the Firm represented a heavy haul logistics company against a broker subsidiary of one of the country’s largest freight railroad networks. After a nine-day trial, the court ruled in our client’s favor, including an award of attorney’s fees.

In Denton County, attorney Diana Brooks obtained summary judgment for the targeted defendant subcontractor in a construction defect case after all other defendants had settled.

September 2018

In Gregg County, attorney Diana Brooks obtained dismissal of a contested guardianship proceeding based on lack of standing by establishing an adverse interest of the petitioner.

In the Fourth Court of Appeals – San Antonio, attorney Diana Brooks obtained a writ of mandamus to the trial court for erroneously denying her client’s motion to compel appraisal on a commercial property damage claim.

March 2017

In the U.S. Fifth Circuit Court of Appeals, attorney Diana Brooks assisted in obtaining an opinion affirming a defense verdict for insurer, based on novel argument that insurer had not waived its rights to deny coverage with knowledge of out-of-state operations.

July 2016

In the U.S. Eastern District of Louisiana, attorney Diana Brooks assisted in obtaining judgment in favor of workers’ compensation insurer against claims by insured employer for coverage of out of state employee’s injuries.
